By accessing our website at progmaze.com or using any of our services, you agree to be bound by these Terms of Service and all applicable laws and regulations. ProgMaze reserves the right to update these terms at any time. We reserve the right, in our sole discretion, to make changes or modifications to these Legal Terms from time to time. We will alert you about any changes by updating the “Last updated” date of these Legal Terms, and you waive any right to receive specific notice of each such change. It is your responsibility to periodically review these Legal Terms to stay informed of updates. You will be subject to, and will be deemed to have been made aware of and to have accepted, the changes in any revised Legal Terms by your continued use of the Services after the date such revised Legal Terms are posted. The Services are intended for users who are at least 18 years old. Persons under the age of 18 are not permitted to use or register for the Services. We recommend that you print a copy of these Legal Terms for your records.

ProgMaze provides professional digital solutions including:

• •Web Development: Custom websites, web applications, and e-commerce platforms using modern technologies like React, Next.js, and Vue.js
• •Mobile Applications: Cross-platform mobile app development for iOS and Android using React Native
• •AI Solutions: Machine learning integration, chatbots, and AI-powered features
• •Consulting Services: Technical advisory, architecture planning, and technology selection
• •Headless CMS: Implementation of headless content management systems
• •Automation & Integration: Workflow automation and third-party system integration
• •Graphic Design: UI/UX design, branding, and visual content creation
• •SEO Services: Search engine optimization and digital marketing

The specific scope of work for your project will be outlined in a separate project proposal or statement of work.

As a ProgMaze client, you agree to:

• •Provide accurate information about your project requirements and business needs
• •Supply necessary materials, content, assets, and access credentials in a timely manner
• •Respond to requests for feedback and approval within agreed timeframes
• •Make yourself or a designated representative available for scheduled meetings
• •Pay invoices according to the agreed payment schedule
• •Not request work that violates laws, regulations, or third-party rights
• •Maintain confidentiality of any proprietary ProgMaze processes or materials

You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Services. You further agree to promptly update account and payment information, including email address, payment method, and payment card expiration date, so that we can complete your transactions and contact you as needed. Sales tax will be added to the price of purchases as deemed required by us. We may change prices at any time.

You agree to pay all charges at the prices then in effect for your purchases and any applicable shipping fees, and you authorize us to charge your chosen payment provider for any such amounts upon placing your order. We reserve the right to correct any errors or mistakes in pricing, even if we have already requested or received payment.

We reserve the right to refuse any order placed through the Services. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same payment method, and/or orders that use the same billing or shipping address. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors.

Upon full payment, you receive ownership of the final deliverables created specifically for you. However:

• •You own the final deliverables: Custom code, designs, and content created for your project
• •ProgMaze retains portfolio rights: We may showcase your project in our portfolio and marketing materials unless restricted by NDA
• •Pre-existing materials: ProgMaze retains ownership of templates, frameworks, libraries, and tools developed before your project
• •Open source components: Third-party open-source code remains subject to its original license
• •Source code: You receive source code for custom development upon full payment

ProgMaze includes a reasonable number of revisions in each project phase:

• •Standard projects include 2-3 revision rounds per phase
• •Revisions must be requested within the agreed review period
• •Minor tweaks within the original scope are included
• •Major changes or new features constitute scope changes

Scope Changes require: • Written change request describing the modifications • Impact assessment on timeline and budget • Written approval before proceeding • Adjusted fees if applicable

Requests beyond included revisions will be quoted separately.

ProgMaze respects the confidentiality of your business information:

• •We keep all client information confidential
• •We don't share your information without permission (except as required by law)
• •We use information only to provide services
• •Our team members sign confidentiality agreements
• •We can sign your NDA if additional protection is needed

You should notify ProgMaze if specific information requires extra confidentiality measures. We treat all client information as confidential by default.

ProgMaze warrants that:

• •Services will be performed professionally and competently
• •Work will substantially conform to agreed specifications
• •We have the legal right to provide the services

However, ProgMaze's services are provided "as is" without additional warranties. We do not guarantee:

• •Specific business results, traffic, or revenue
• •Uninterrupted or error-free operation
• •Compatibility with all future technologies
• •Specific search engine rankings

Any specific guarantees will be explicitly stated in your project agreement.

To the fullest extent permitted by law:

• •ProgMaze's total liability for any claim is limited to the amount you paid for the specific services
• •We are not liable for indirect, consequential, or punitive damages
• •We are not liable for lost profits, data loss, or business interruption

These limitations apply regardless of the legal theory of the claim. Some jurisdictions don't allow certain limitations, so some may not apply to you.

For ongoing hosting and maintenance services:

• •ProgMaze can recommend and help configure hosting providers
• •We offer optional maintenance packages for updates and support
• •Hosting fees are paid directly to your chosen hosting provider
• •Maintenance contracts are separate from development contracts
• •Services can be terminated with 30 days notice

Emergency support and urgent fixes may be available outside of maintenance hours at premium rates.

Either party may terminate the agreement:

• •Client may cancel with written notice, paying for work completed to date
• •ProgMaze may terminate for non-payment or breach of terms
• •Upon termination, all completed work is delivered to the client
• •Outstanding invoices remain due
• •Licenses to deliverables are granted upon full payment

Deposits are non-refundable once work has commenced. Refund requests are handled case-by-case.

In case of disputes:

• •Parties agree to first attempt resolution through good-faith discussion
• •If discussion fails, mediation will be attempted before litigation
• •Disputes will be resolved under the laws of [Your Jurisdiction]
• •Any legal action must be filed within one year of the dispute arising

ProgMaze prefers to resolve all issues amicably and professionally.

ProgMaze may integrate third-party services into your project:

• •APIs and services (payment gateways, analytics, etc.) are subject to their own terms
• •ProgMaze is not responsible for third-party service outages or changes
• •You are responsible for obtaining necessary licenses for third-party services
• •Costs for third-party services are your responsibility unless otherwise agreed

We select reputable providers but cannot control their performance or policies.

Additional terms:

• •These terms, your project agreement, and our Privacy Policy constitute the entire agreement
• •If any provision is unenforceable, the rest remains in effect
• •ProgMaze's failure to enforce a right doesn't waive that right
• •You may not transfer your rights without our written consent
• •ProgMaze may assign its rights without restriction
• •Force majeure: Neither party is liable for delays due to circumstances beyond reasonable control
